These Terms of Service ("Terms") govern your access to and use of the Prep with Sofie website, currently accessible at https://prepwithsofie.vercel.app/, and all related services, features, content, and applications offered by "Prep with Sofie," "we," "us," or "our" (collectively, the "Service").
By creating an account, accessing, or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available at the website), which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Service.
You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Service. If you are under this age, you are not permitted to use the Service.
Prep with Sofie is an online platform that utilizes Artificial Intelligence (AI) to analyze the content of a user's uploaded Curriculum Vitae (CV). Based on this analysis, the Service generates personalized reports, questions, audio content, referred to as "micro-podcasts," designed to aid users in their competency development and preparation for interviews.
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account password and any other credentials used to access your account. You agree not to disclose your password to any third party. You are solely responsible for any activities or actions taken under your account, whether or not you have authorized such activities or actions.
You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You retain all ownership rights to the information, text, and other materials you upload or provide to the Service, specifically your Curriculum Vitae (collectively, "User Content").
By uploading or submitting User Content to the Service, you grant Prep with Sofie a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, process, adapt, modify, publish (solely within your account for your access), transmit, and display your User Content solely for the purpose of operating, providing, and improving the Service to you. This includes using your CV data to generate the personalized micro-podcasts. This license ends when your User Content is deleted from our systems as described in our Privacy Policy and these Terms.
You are solely responsible for your User Content, including its legality, accuracy, reliability, and appropriateness. You represent and warrant that you own or have the necessary rights and permissions to use and authorize us to use your User Content as described herein. You agree not to submit User Content that is unlawful, defamatory, infringing, or otherwise objectionable.
The personalized audio micro-podcasts generated by the Service based on your User Content ("Generated Content") are created for your use. While you own your underlying User Content (your CV data), Prep with Sofie retains ownership of the specific expression and compilation of the audio content generated by its AI, subject to your license below.
Prep with Sofie grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Generated Content solely for your personal, non-commercial interview preparation and competency development purposes.
You may not sell, rent, lease, distribute, broadcast, sublicense, or otherwise assign any rights to the Generated Content to any third party. You may not use the Generated Content for any commercial purposes without obtaining prior written permission from Prep with Sofie.
Excluding your User Content and the limited rights granted to you for Generated Content, the Service itself, including but not limited to its software, platform architecture, design, text, graphics, logos, trademarks, service marks, patents, copyrights, and all other intellectual property rights therein or related thereto (collectively, "Our IP"), are and will remain the exclusive property of "Prep with Sofie" and its licensors. You agree not to copy, modify, create derivative works of, publicly display, publicly perform, or republish any of Our IP.
We welcome feedback, comments, and suggestions for improvements to the Service ("Feedback"). You can submit Feedback by emailing us at juliusz@mandrosz.dev.
You grant to us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable, and transferable license under any and all intellectual property rights that you own or control to use, copy, modify, create derivative works based upon, and otherwise exploit the Feedback for any purpose, without any obligation or compensation to you.

WITHOUT LIMITING THE FOREGOING, "PREP WITH SOFIE" EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WE MAKE NO WARRANTY THAT THE SERVICE OR GENERATED CONTENT WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SERVICE, INCLUDING THE GENERATED CONTENT.
THE AI USED BY THE SERVICE MAY PRODUCE INACCURACIES OR OMISSIONS IN THE GENERATED CONTENT. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND VERIFYING THE ACCURACY AND APPROPRIATENESS OF ANY GENERATED CONTENT BEFORE RELYING ON IT. PREP WITH SOFIE IS NOT RESPONSIBLE FOR THE OUTCOMES OF ANY JOB APPLICATIONS, INTERVIEWS, OR CAREER DECISIONS YOU MAKE BASED ON THE USE OF THE SERVICE OR GENERATED CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER "PREP WITH SOFIE" NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT (INCLUDING USER CONTENT AND GENERATED CONTENT) OBTAINED FROM OR USED THROUGH THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PREP WITH SOFIE TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICE OR CONTENT EXCEED THE AMOUNTS YOU HAVE PAID TO PREP WITH SOFIE FOR USE OF THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED EUROS (€100.00) (OR EQUIVALENT IN LOCAL CURRENCY), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS TO PREP WITH SOFIE, AS APPLICABLE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless "Prep With Sofie" and its officers, directors, employees, agents, and licensors from and against any and all claims, disputes, demands, liabilities, damages, losses, costs, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Service or Content (including User Content and Generated Content), (ii) your User Content, or (iii) your violation of these Terms.
You can stop using the Service at any time. You may request the deletion of your account and associated User Content by contacting us at juliusz@mandrosz.dev, as detailed in our Privacy Policy.
We may suspend or terminate your access to and use of the Service, at our sole discretion, at any time and without notice to you, including if (a) you breach these Terms; (b) you create risk or possible legal exposure for us; or (c) our provision of the Service to you is no longer commercially viable.
Upon any termination, discontinuation, or cancellation of the Service or your account, all provisions of these Terms which by their nature should survive will survive, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.
These Terms and any action related thereto will be governed by the laws of Spain, without regard to its conflict of laws provisions.
We want to address your concerns without needing a formal legal case. Before filing a claim against Prep with Sofie, you agree to try to resolve the dispute informally by contacting juliusz@mandrosz.dev. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within sixty (60) days of submission, you or Prep with Sofie may bring a formal proceeding.
You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.
We may modify these Terms from time to time. If we make changes that we believe are material, we will notify you by posting the revised Terms on the Service and updating the "Last Updated" date at the top of these Terms. We may also provide notice to you through the Service's interface or by sending an email to the address associated with your account at least fifteen (15) days before the material changes become effective. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service.
These Terms, together with our Privacy Policy, constitute the entire and exclusive understanding and agreement between Prep with Sofie and you regarding the Service and Content, and these Terms supersede and replace any and all prior oral or written understandings or agreements between Prep with Sofie and you regarding the Service and Content.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Prep with Sofie.
You may not assign or transfer these Terms, by operation of law or otherwise, without Prep with Sofie's prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null. Prep with Sofie may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
Any notices or other communications provided by Prep with Sofie under these Terms, including those regarding modifications to these Terms, will be given: (i) via email; or (ii) by posting to the Service. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.
The controlling language of these Terms is English. If a translation has been provided for convenience, the English version will govern in case of any discrepancies.
